During the financial crisis in 2009, Richard D. Faulkner and Harry W. Zanville joined forces and filed a lawsuit for terminated General Motors and Chrysler Dealers against the Government. The Fifth Amendment of the US Constitution protects against Government “taking” of private property for public use without “just compensation”. The GM and Chrysler Dealerships whose property interests were damaged and taken by Government action must be paid for the unnecessary termination of their Dealerships. We maintain that Dealerships are entitled by the Takings Clause of the Fifth Amendment of the US Constitution to be paid just compensation by the Federal Government.
